1. Introduction & Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the TraderSign website, web application, APIs and related services (collectively, the "Platform") provided by TraderSign Sdn. Bhd. (202501012050) ("TraderSign", "we", "us", or "our").

By accessing or using the Platform, creating an account, or continuing to use the services after changes to these Terms, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must not access or use the Platform.

2. Definitions

• Platform – the TraderSign website, web application, APIs, and all related software, content and services.
• User, you, or your – any individual or entity that accesses or uses the Platform.
• Subscription – a paid plan that provides access to certain features of the Platform on a recurring basis.
• Trial – a temporary free period during which you may access the Platform subject to these Terms.
• Content – any information, data, text, images, graphics, or other materials uploaded, submitted, or displayed on or through the Platform.

3. Eligibility & Account Registration

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into a binding contract under Malaysian law.

• You agree to provide accurate, complete and current registration information.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You must promptly update your account information (including email and billing details) so that it remains accurate and complete.
• We reserve the right to suspend or terminate your account if we reasonably believe that any information you provide is false, misleading or incomplete, or if you violate these Terms.

4. Scope of Services

TraderSign provides an online trading journal and analytics Platform that enables Users to log, track, and analyse their trading activity across different accounts and instruments. Features may include, among others, trade journaling, performance analytics, tag-based analysis, charting integrations and reporting tools.

TraderSign does not:

• provide investment, trading, tax, legal, or financial advice;
• execute trades or orders on your behalf;
• act as a broker, dealer, investment adviser, or any regulated financial intermediary.

All tools and information provided through the Platform are for educational and analytical purposes only. You are solely responsible for any trading or investment decisions you make.

5. Risk Disclosure

Trading financial instruments (including forex, CFDs, stocks, indices, futures, options and cryptocurrencies) involves a high level of risk and may not be suitable for all investors. You may lose some or all of your invested capital. Past performance, simulated or actual, is not indicative of future results.

6. User Conduct

You agree to use the Platform only for lawful purposes and in accordance with these Terms. Without limiting the foregoing, you agree that you will not:

• Upload, post, transmit or otherwise make available any Content that is unlawful, harmful, defamatory, obscene, harassing, hateful, or otherwise objectionable, or that infringes any third-party rights.
• Attempt to gain unauthorized access to any portion of the Platform, other user accounts, or any systems or networks connected to the Platform.
• Use the Platform to distribute unsolicited or unauthorized advertising, spam, chain letters, or similar forms of solicitation.
• Upload or transmit any viruses, worms, malware or other code that may damage or interfere with the operation of the Platform or any hardware or software.
• Use the Platform in any way that could disable, overburden, damage, or impair the Platform or interfere with any other party’s use of the Platform.

We reserve the right, but have no obligation, to monitor or review any Content and to remove Content or suspend accounts at our sole discretion if we believe these Terms have been violated.

7. Subscriptions, Billing & No-Refund Policy

Access to certain features of the Platform is provided on a subscription basis. Subscriptions are billed in advance and renew automatically unless cancelled.

• We process payments via Stripe through Laravel Cashier. By providing your payment details, you authorize us to charge the applicable fees to your payment method.
• Subscription fees are billed on a recurring monthly or annual basis as selected at sign-up. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
• All payments are final and non-refundable. We do not provide refunds or partial refunds for unused time, downgrades, or failure to cancel before renewal.
• We reserve the right to change our pricing and subscription plans. Any changes will be communicated with reasonable prior notice, and will apply on your next renewal after the effective date of the change.

8. Free Trial

TraderSign may offer a free trial of its subscription plans for a limited period (currently 7-days). A valid payment method is required to start the trial.

• At the end of the 7-day free trial, your payment method will be automatically charged for the selected subscription unless you cancel before the trial ends.
• Each User is generally eligible for only one free trial, unless otherwise specified by TraderSign.
• We may modify or discontinue free trial offers at any time without notice.

9. Data Protection & Privacy (PDPA 2010)

TraderSign processes personal data in accordance with the Malaysian Personal Data Protection Act 2010 ("PDPA") and our Privacy Policy.

• By using the Platform, you consent to the collection, use and processing of your personal data as described in our Privacy Policy.
• We may store and process data on servers located in Malaysia or in other jurisdictions using reputable third-party providers with appropriate safeguards.
• You have the right to request access to and correction of your personal data. For such requests, contact us at contact@tradersign.com.

10. Intellectual Property

The Platform and all its content, features and functionality (including but not limited to software, text, graphics, logos and design) are owned by TraderSign or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use, subject to these Terms. You may not:

• copy, modify, distribute, sell, or lease any part of the Platform or its content;
• reverse engineer or attempt to extract the source code of any software on the Platform;
• remove or alter any proprietary notices, trademarks, or labels on the Platform.

11. User Content & Licence

You retain ownership of any Content you upload or submit to the Platform. However, by uploading or submitting Content, you grant TraderSign a worldwide, non-exclusive, royalty-free licence to host, use, reproduce, process, and display such Content as reasonably necessary to operate, maintain and improve the Platform.

You represent and warrant that you have all rights necessary to upload the Content and that it does not infringe any third-party intellectual property or other rights.

12. Termination & Suspension

You may terminate your account at any time by using the account settings in the Platform or by contacting us at contact@tradersign.com.

We may suspend or terminate your account or access to the Platform, with or without notice, if we reasonably believe that you have violated these Terms, created risk or possible legal exposure for TraderSign, or for any other reason at our sole discretion.

Upon termination, your right to access and use the Platform will immediately cease. Certain data may be retained as required by law or for legitimate business purposes, subject to our Privacy Policy.

13. Indemnification

You agree to indemnify, defend and hold harmless TraderSign, its directors, officers, employees, agents and affiliates from and against any claims, liabilities, damages, losses, costs or expenses (including reasonable legal fees) arising out of or related to:

• your use or misuse of the Platform;
• your violation of these Terms;
• any Content you upload or submit to the Platform; or
• your violation of any third-party rights.

14. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, TraderSign disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected. Your use of the Platform is at your sole risk.

15. Limitation of Liability

To the fullest extent permitted by law, TraderSign, its directors, officers, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Platform.

In no event shall TraderSign’s total liability to you for all claims arising out of or relating to these Terms or the Platform exceed the amount of subscription fees you have paid to TraderSign in the twelve (12) months immediately preceding the event giving rise to such claim.

16. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide you with reasonable prior notice by email or through the Platform. The updated Terms will be effective as of the date specified in the notice.

By continuing to access or use the Platform after any changes become effective, you agree to be bound by the revised Terms.

17. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the High Court of Malaya at Kuala Lumpur.

18. Entire Agreement & Contact

These Terms, together with any other policies or agreements expressly incorporated by reference (including our Billing & Payment Policy and Privacy Policy), constitute the entire agreement between you and TraderSign regarding your use of the Platform and supersede all prior agreements and understandings.
